Response:

1. Please can you confirm how and how regularly you confirm you and your suppliers are IR35 compliant? Our suppliers are from accredited NHS Frameworks, and those frameworks stipulate that suppliers need to adhere to legislative requirements. The Trust also uses the HMRC e-assessment tool to determine IR35 status for agency workers when this is disputed by the provided. Our default position will also be that any worker would be inside IR35  unless we receive evidence to the contrary and this is verified by the assessment tool.
2. Please can you confirm the percentage of agency shifts in the past financial year that were NHSI cap compliant? Please could you break this down by staff group?

The Trust does not record the percentage of compliance by staff group. We are required to submit agency data to NHS Improvement on a weekly basis and the data we provide is used to populate the NHS Improvement Model Hospital reports. According to the latest Model Hospital reporting (August 19 data) 85% of all agency shifts used by the Trust are compliant with the NHSI Price Caps.
