REF:            2016-188

Subject:        Modern Slavery

Request:

Are staff in your Trust made aware (through circulated information, training, or any other mechanism) that, in accordance with the Modern Slavery Act 2015 s52 and Modern Slavery Act 2015 (Duty to Notify) Regulations 2015 (SI 2015/1743) (Regulations), they are encouraged to submit any suspected cases of modern slavery and human trafficking using the MS1 form to the National Crime Agency?

If NO:

(a) Is the development of advice on the process of using the MS1 form alongside the National Referral Mechanism and Safeguarding forthcoming?

(b) Are you planning on requiring staff to complete the Human Trafficking Programme for NHS healthcare staff via the Electronic Staff Record (ESR)?

Response:

Are staff in your Trust made aware (through circulated information, training, or any other mechanism) that, in accordance with the Modern Slavery Act 2015 s52 and Modern Slavery Act 2015 (Duty to Notify) Regulations 2015 (SI 2015/1743) (Regulations), they are encouraged to submit any suspected cases of modern slavery and human trafficking using the MS1 form to the National Crime Agency? Not at the moment, our policy states all referrals should be made to the Police by contacting 101 and the Lead Nurse for Safeguarding should be informed. If the identified person is at risk of imminent harm both Security and Police should be informed immediately.
If NO:
(a) Is the development of advice on the process of using the MS1 form alongside the National Referral Mechanism and Safeguarding forthcoming? Not at the present time.
(b) Are you planning on requiring staff to complete the Human Trafficking Programme for NHS healthcare staff via the Electronic Staff Record (ESR)? Human Trafficking level 1 is currently incorporated within our safeguarding training, we are currently working on level 2 being built into the training and level 3 is planned to be applied around September 2016.
